Terms of Use

• By accessing and using the Services provided by the Platform, the User agrees that the User has read and understood the Terms of Use applicable to the User. These Terms of Use and the Company’s policies constitute a legally binding agreement between the User and the Company.
• If the User does not agree to the Terms of Use, please do not continue to access the Platform and/or use the Services.
•  The Company may modify the terms of these Terms of Use at any time.

Such modifications will be notified to the User via the company’s website and NVCharge application.

The User is responsible for regularly reviewing the Terms of Use. Continued use of the Services after any changes, regardless of whether the User has reviewed them or not, will be deemed to be the User’s acceptance and agreement to such changes.

•  In the event of any conflict between these Terms of Use and the subsequent Additional Terms, the following additional terms shall apply.

Definitions and interpretations

•  Platform: means the electronic platforms developed by the Company to provide electric vehicle charging services and electric vehicle charging management.

NVCharge product set and NVCharge management system. The specific contents of NVCharge are provided by the Company to customers according to the actual situation, mainly including registration/login with mobile phone account number, finding Charging Station, using remote monitoring technology to manage electric vehicle charging time and charging method; At the same time, it provides data on charging time and cost, existing charging stations in the vicinity to serve the charging needs of users and other services launched in the future.

•  Service: is the charging service provided by the Company to Users.
•  Service fee: Is the amount that Users must pay for using the service provided by the Company, according to the service fee schedule prescribed at each time.
•  Customers: Are individuals and organizations that have charging needs and provide charging services under the NVCharge brand provided by the Company through the platform.
•  Users: Are individuals who register for an NVCharge account and use the service.
•  Charging station: Is the location where the Company’s NVCharge charging equipment is installed and is ready to provide Services through the Platform.
•  Successful Transaction: Is a charging transaction performed by the User – the payment of the Service Fee has been completed, and the Plug has been pushed out of the Charging Station, ready for the User to use.
•  Intellectual Property: Is any patent, copyright, industrial design, registered or unregistered design, industrial design right, trademark, registered or unregistered design or any other intellectual property, including applications for any of the above.

Representations, Warranties and Commitments

By accessing NVCharge and using the Service, the User agrees and undertakes that:

•  All information provided by the User is accurate and will be promptly updated to the company through the platform when there is a change;
•  The User will only use the Platform and Services for lawful purposes and intentions;
•  The User is required to confirm that he/she has understood the Company’s service fee regulations through the payment operations on the platform before using the service. Only when the User agrees to pay the relevant fees in the prompt can the User use the service. If the User refuses to make the payment, the Company has the right not to provide the Service to the User;
•  The User will manage and secure his/her account or any identification method we provide for the User to use the service;
•  The User will notify the Company immediately of any unauthorized use of the User’s account or any other security breach;
•  The User will use and preserve the information carefully, in accordance with the instructions and warnings for use specified on the product and Platform;
•  The User shall provide the Company with identifying information such as full name, telephone number, address, email, etc., or any other documents, permissions, licenses or approvals on the Platform that the Company may reasonably require to provide the Service;
•  The Service is provided on a reasonable commercial effort basis;
•  The User shall assume full responsibility and liability for all losses or damages caused to the User, the Company or any third party as a result of the User’s violation of these Terms of Use through no fault of the Company or a Third Party;
•  The User shall not remove, alter or obscure the content displayed on the Platform or on the product or on any device provided to the User by the Company;
•  The User shall not lend, lend, rent, lease, or rent, sell, resell or other commercial or profit-making activities from the Company’s Services or products provided through the Platform without the Company’s consent; otherwise, all consequences and responsibilities arising from the above actions will belong to the User;
•  The Company may also take measures to suspend the service depending on the situation and remind the User through other relevant media and information channels.

Buyers Get Refunds

•  Users can completely complain and make a decision to request a Refund within 2 days (excluding Saturdays and Sundays, for holidays, users please follow NVCharge’s notice). If your complaint is valid, NVCharge will refund you within 3-5 days (refund according to your payment method)
•  Users complaining and requesting a Refund immediately will also indirectly help NVCharge detect other fraudulent

PRIVACY POLICY

User Account Policy

•  The User warrants and declares that the User is at least eighteen (18) years old and has full capacity and human behavior required by current law to participate in this agreement and use the Company’s services. If the User is under 18 years of age or lacks the necessary capacity, the User must obtain the User’s parent or guardian’s permission to use our services, and the User’s parent or guardian may, under applicable law, be held responsible for the User’s acts or omissions in connection with the User’s access to the platform or use of the Company’s services;
•  The User’s account contains the User’s personal and financial information. The User shall keep his/her account confidential and, unless expressly authorized by us, the User shall not, directly or indirectly, create an account for another person, transfer the User’s account to another person, or permit or assist any other person to use or access the User’s account. The User agrees to bear all legal liability arising from the access or use of the User’s account by others;
•  Until the User reports the lost or stolen account details to the Company, the User shall be liable for any loss and damage arising from the disclosure of the User’s account details or any electronic threat, attack or fraudulent activity due to the User’s failure to protect the security of the User’s account details;
•  All activities performed through the User’s account are deemed to have been performed by the User. The User shall be responsible for all activities performed through the User’s account, regardless of whether such activities were performed with the User’s consent or witness;
•  The User may change or update at any time the contents of the Personal Information section in the Account section on the NVCharge application;
•  The Company reserves the right to refuse any request for service and, subject to the Company’s policy from time to time, terminate the User’s account and/or deny the User access to the Platform without specifying or providing any reason.
•  The User agrees that the Company has the right to display various types of commercial advertisements or any other commercial information in various ways during the provision of Services on the Platform.

Regarding the use of information:

•  The Company will not use the User’s personal information through the Platform without permission. If the User agrees to provide personal information, the User will be protected.
•  The User’s information will be used for the purpose of contacting the User to notify the Company of updates such as payment confirmation, transaction troubleshooting, promotions via email or mobile messages.
•  The User’s personal information will not be sent to anyone outside the Company, except for the necessary extensions for the User to participate in the website (service providers, partners, advertising companies) and the requirements provided by law. If the Company shares the User’s personal information with service providers, advertising companies, related partner companies, the Company also requires them to protect the User’s personal information in the same way we do.

Privacy Policy

•  The Company values ​​information security and uses the best measures to protect the User’s information and payment. Information of The user’s payment process will be encrypted to ensure safety. After the user completes the payment process, the user will exit the safe mode.
•  The user is not allowed to use any program, tool or other form to interfere with the system or change the data structure or disseminate, propagate or encourage any activity to interfere, sabotage or infiltrate the system’s data. Individuals or organizations that violate will be deprived of all rights and will be prosecuted before the law if necessary. All transaction information will be kept confidential except in cases where it is required to be provided at the request of the court, competent authority(ies) or as prescribed by law.
